Agreement to Terms

These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and e-tuitions Learning Pvt Ltd ("Company", "we", "us", or "our"), concerning your access to and use of the http://e-tuitions.com website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "Site"). The Site provides an online marketplace for the following goods, products, and/or services: Educational services - online courses offered by teachers to students (the "Marketplace Offerings"). In order to help make the Site a secure environment for the purchase and sale of Marketplace Offerings, all users are required to accept and comply with these Terms of Use. You agree that by accessing the Site and/or the Marketplace Offerings, you have read, understood, and agree to be bound by all of these Terms of Use. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF USE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND/OR THE MARKETPLACE OFFERINGS AND YOU MUST DISCONTINUE USE IMMEDIATELY.

Supplemental terms and conditions or documents that may be posted on the Site from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Use at any time and for any reason. We will alert you about any changes by updating the "Last updated" date of these Terms of Use, and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Terms of Use to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Terms of Use by your continued use of the Site after the date such revised Terms of Use are posted.

The information provided on the Site is not intended for distribution to or use by any person or entity in any jurisdiction or country, where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. Accordingly, those persons who choose to access the Site from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.

All users who are minors in the jurisdiction in which they reside (generally under the age of 18) must have the permission of, and be directly supervised by, their parent or guardian to use the Site. If you are a minor, you must have your parent or guardian read and agree to these Terms of Use prior to you using the Site.

e-Tuitions reserves the right to update the terms & conditions as well as other policies, without giving any prior notice to the users. The users are responsible to read the terms & conditions regularly.

If the user doesn't agree with any of the terms & conditions at e-Tuitions, kindly do not register at the website.

Intellectual Property Right

Unless otherwise indicated, the Site and the Marketplace Offerings are our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of the United States, international copyright laws, and international conventions. The Content and the Marks are provided on the Site "AS IS" for your information and personal use only. Except as expressly provided in these Terms of Use, no part of the Site or the Marketplace Offerings and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

Provided that you are eligible to use the Site, you are granted a limited license to access and use the Site and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use. We reserve all rights not expressly granted to you in and to the Site, the Content and the Marks.

User Presentation

By using the Site or the Marketplace Offerings, you represent and warrant that:(1) all registration information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information and promptly update such registration information as necessary; (3) you have the legal capacity and you agree to comply with these Terms of Use; (4) you are not a minor in the jurisdiction in which you reside, or if a minor, you have received parental permission to use the Site; (5) you will not access the Site or the Marketplace Offerings through automated or non-human means, whether through a bot, script or otherwise; (6) you will not use the Site for any illegal or unauthorized purpose; and (7) your use of the Site or the Marketplace Offerings will not violate any applicable law or regulation.

If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Site (or any portion thereof).

You may not use the Site or the Marketplace Offerings for any illegal or unauthorized purpose nor may you, in the use of Marketplace Offerings, violate any laws. Among unauthorized Marketplace Offerings are the following: intoxicants of any sort; illegal drugs or other illegal products; alcoholic beverages; games of chance; and pornography or graphic adult content, images, or other adult products. Postings of any unauthorized products or content may result in immediate termination of your account and a lifetime ban from use of the Site.

We are a service provider and make no representations as to the safety, effectiveness, adequacy, accuracy, availability, prices, ratings, reviews, or legality of any of the information contained on the Site or the Marketplace Offerings displayed or offered through the Site. You understand and agree that the content of the Site does not contain or constitute representations to be reasonably relied upon, and you agree to hold us harmless from any errors, omissions, or misrepresentations contained within the Site’s content. We do not endorse or recommend any Marketplace Offerings and the Site is provided for informational and advertising purposes only.

User Registration

You may be required to register with the Site in order to access the Marketplace Offerings. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.

Marketplace Offerings

In Short: We collect personal information that you provide to us such as name, address, contact information, passwords and security data, and payment information.

We collect personal information that you voluntarily provide to us when registering at the expressing an interest in obtaining information about us or our products and services, when participating in activities on the (such as posting messages in our online forums or entering competitions, contests or giveaways) or otherwise contacting us. The personal information that we collect depends on the context of your interactions with us and the, the choices you make and the products and features you use. The personal information we collect can include the following: Name and Contact Data. We collect your first and last name, email address, postal address, phone number, and other similar contact data. Credentials. We collect passwords, password hints, and similar security information used for authentication and account access. Payment Data. We collect data necessary to process your payment if you make purchases, such as your payment instrument number (such as a credit card number), and the security code associated with your payment instrument. All payment data is stored by our payment processor and you should review its privacy policies and contact the payment processor directly to respond to your questions. Social Media Login Data. We provide you with the option to register using social media account details, like your Facebook, Twitter or other social media account. If you choose to register in this way, we will collect the Information described in the section called "HOW DO WE HANDLE YOUR SOCIAL LOGINS" below. All personal information that you provide to us must be true, complete and accurate, and you must notify us of any changes to such personal information. Information automatically collected.

Service Fees to be paid by Teachers

On every payment for online classes arranged by e-Tuitions, the company charges service fees from the teachers. The said service fees is in consonance with the payment terms. The service fees shall be applicable to the teacher @ 35%, excluding the taxes. The taxes may be applicable according to the government rules.

Guidelines for Teachers/ Tutors

All the teachers/ tutors are advised to follow the following guidelines while they teach any student at e-Tuitions:

1. If a student books a demo class with you, then please ensure that you attend the demo class. In case of unavoidable circumstances, if you have to cancel the demo class, then you can do that 2 hours before the scheduled time of the class. In case a teacher fails to attend the demo class, it will result in a penalty.

2. If a teacher is not able to attend a demo class, then he/ she can reschedule the demo class, after discussing and deciding on a convenient time for both the teacher and the student. In case you are not able to contact the student then the teacher may contact e-Tuitions via mail or call, to reschedule the demo class. Teachers must ensure to reschedule the demo class at least 2 hours before the demo class starts.

3. In case a teacher is not able to attend an online class, the she must inform the student at least 2 hours before the class. Failing to do so will lead to a penalty. The teacher must also reschedule the missed class to convenient time after discussion with the student or e-Tuitions. Teachers must also reschedule a class, if a student fails to appear for the class. The same is to be done, after discussion with the student. In case a teacher faces any difficulty in doing so, then they are to contact e-Tuitions.

4. Teachers may not ask the students and their parents for their contact numbers or any other details. Teachers are also not supposed to share their own contact numbers or any other personal details with the students or their parents.

5. Teachers must not accept any kind of payment from the students or the parents, for the online classes, outside of the payments paid to them by e-Tuitions.

6. If a teacher is found not following any of these guidelines, then penalties may include deduction of payment or suspension of their teacher’s account temporarily or permanently.

7. The teachers must ensure that they are logged in to their e-Tuitions account, 5 minutes before a class is scheduled. It will give them time to be prepared for the class.

8. Teachers must ensure that the duration of every online class is 60 minutes.

9. Teachers must not take an online class with an e-Tuitions student at any other platform/ website/ app, apart from e-Tuitions website. In case the class is taken at any other platform then, the class will not be counted/ considered by e-Tuitions in the total number of classes.

10. In case a teacher comes across any technical problem/ difficulty while taking the online class at e-Tuitions website, then he/ she must contact & inform e-Tuitions for the same. In the aforementioned situation the teacher must not take the class at any other website/ app/ platform.

11. In case an online class does not take place, because of a technical problem with e-Tuitions website, then the teachers will have to reschedule the class after a discussion with the student or e-Tuitions.

12. Teachers have to ensure that they keep their cameras on for the entire duration of the online class.

13. Teachers can conduct online tests, to evaluate the performance of the students.

14. Teachers are requested to share the performance evaluation reports of students, with the parents, after every test.

15. e-Tuitions reserves the right to suspend a teacher’s account, if the teacher is found sharing contact information with any student during online class, via text or any other means of communication.

16. e-Tuitions reserves the right to suspend a teacher’s account if he/ she is found giving online classes to an e-Tuitions student outside of the e-Tuitions platform.

17. e-Tuitions reserves the right to suspend a teacher’s account if he /she is found encouraging students to take online classes from him/ her outside the e-Tuitions platform, without informing e-Tuitions Learning Pvt. Ltd.

18. e-Tuitions reserves the right to suspend a teacher’s account if he/she is found asking for or accepting any payment from the students or parents.

19. If a teacher, for any reasons, fails to deliver the booked number of classes to a student, then the fee/ payment of classes delivered by the teacher will be released or forfeited as per the following:

If a teacher is unable to deliver the total number of classes booked by a student, then the teacher must inform e-Tuitions of the same through mail (education@e-tuitions.com) or call (9311656688).

If a teacher doesn’t inform e-Tuitions about the inability to deliver the total number of classes booked by a student and, also doesn’t respond to three consecutive attempts of communication by e-Tuitions team, in the form of mail, call or texts, then the entire fee (fee for delivered as well as undelivered classes) of the said teacher will be forfeited.

If the teacher has delivered at least 60% of the booked classes and communicates the inability to complete the total number of classes booked by the student to e-Tuitions, the payment/ fee for the delivered classes will be paid on pro rata basis.

Payment guidelines for Teachers and Students

1. A student is required to renew his/ her classes with a teacher only after the promised number of classes for a month are delivered. If due to any reason a teacher is not able to provide all the classes for a month, then the student does not need to renew the classes, unless all the classes for a certain month are exhausted.

2. e-Tuitions provides different payment methods to teachers & students, such as debit card, credit card, UPI, net banking etc. All these payment methods are absolutely secure.

3. e-Tuitions doesn’t store any information related to the debit card/ credit card or net banking details of the students & teachers.

4. e-Tuitions will never ask a student or parent for their debit/ credit card details or any other details related to your bank account. Kindly never share your card or bank details with anyone via SMS, text/ mall or on call.

5. Teachers, students & parents must always review the payment before making the final payment. In case of a dispute, you are requested to contact & inform e-Tuitions.

6. If a teacher doesn’t take a class/ classes then the students will get a refund for the same on pro rata basis. The refund amount will be transferred to the student’s wallet which he/ she can use for other online classes in future.

7. Once e-Tuitions receive the payment request from a teacher, it will take 5-7 business days for the payment to be transferred to the teacher’s bank account.
